Overview

In Octo­ber 2011, The United Nations Human Rights Coun­cil will assess Haiti’s com­pli­ance with its human rights law oblig­a­tions as part of Uni­ver­sal Peri­odic Review. This joint sub­mis­sion filed by the Lawyers’ Earth­quake Response Net­work (LERN), the Bureau des Avo­cats Inter­na­tionaux (BAI) and the Insti­tute for Jus­tice & Democ­racy in Haiti (IJDH), sum­ma­rizes human rights issues raised in 13 stake­holder reports sub­mit­ted by a coali­tion of 57 grass­roots groups, inter­nally dis­placed per­sons (IDP) camps, non-governmental orga­ni­za­tions and aca­d­e­mic insti­tu­tions rep­re­sent­ing a diverse spec­trum of Hait­ian stake­hold­ers. The coali­tion rec­og­nizes the immense chal­lenges the Gov­ern­ment of Haiti has faced fol­low­ing the dev­as­ta­tion wrought by the Jan­u­ary 12, 2010, earth­quake. While the earth­quake has cre­ated new chal­lenges, the fail­ure of the Gov­ern­ment of Haiti to respect, pro­tect and ful­fill human rights pre-dates the earth­quake. The coali­tion urges the Gov­ern­ment of Haiti to use this oppor­tu­nity to review its per­va­sive short­com­ings in both its poli­cies and prac­tices, and to com­mit to not rebuild Haiti as it existed prior to the earth­quake, but to build it into a coun­try that respects and pro­motes human rights in a sus­tain­able and autonomous fash­ion. It also rec­og­nizes the role of the inter­na­tional com­mu­nity in Haiti’s devel­op­ment and recon­struc­tion and urges inter­na­tional actors to imple­ment a human rights based approach that sup­ports the Government’s efforts toward the real­iza­tion of rights.
